Rental vehicles must be covered by compulsory third-party liability insurance<\/strong>.<\/p>\n\n\n\n
This insurance is intended to cover, within the applicable policy limits, damage caused by the insured vehicle to third-party property or people.<\/p>\n\n\n\n
This means that if you cause an accident while driving a rental car and damage another vehicle, the damage suffered by the other party will generally be handled under the vehicle’s third-party liability insurance.<\/p>\n\n\n\n

If the rental vehicle is damaged, you need to check what level of financial liability remains with the customer under the rental agreement<\/strong>.<\/p>\n\n\n\n
Many rental rates include a limitation of liability for certain types of vehicle damage, commonly referred to as CDW, or Collision Damage Waiver<\/strong>.<\/p>\n\n\n\n
CDW does not necessarily mean that every type of damage is fully covered.<\/p>\n\n\n\n
For covered damage, the rental agreement may set a maximum liability amount<\/strong>, commonly referred to as the excess.<\/p>\n\n\n\n

The third-party liability insurance limit and the excess are two separate concepts.<\/p>\n\n\n\n
The third-party liability insurance limit<\/strong> is the maximum amount covered by the insurance policy for damage caused to third parties.<\/p>\n\n\n\n
The excess or maximum liability for damage to the rental vehicle<\/strong>, on the other hand, concerns the relationship between the customer and the rental company for certain types of damage.<\/p>\n\n\n\n
The third-party liability insurance limit should therefore not be used to determine how much the customer may have to pay for repairs to the rental vehicle.<\/p>\n\n\n\n
<\/span>What happens if the accident is my fault?<\/strong><\/span><\/h2>\n\n\n\n
If you are responsible for the accident, damage caused to third parties will be handled under the applicable third-party liability insurance.<\/p>\n\n\n\n
For damage to the rental vehicle itself, you need to check the rental agreement.<\/p>\n\n\n\n
If the damage falls within the applicable liability limitation, the customer may be required to pay the chargeable amount up to the stated maximum limit<\/strong>.<\/p>\n\n\n\n
If you purchased additional protection that reduces or waives that liability, the amount may be lower or, for covered events, reduced to zero.<\/p>\n\n\n\n
This does not necessarily mean that every cost is eliminated: there may still be exclusions, administration fees, roadside assistance costs or types of damage that are not covered<\/strong>.<\/p>\n\n\n\n
<\/span>What happens if the accident is not my fault?<\/strong><\/span><\/h2>\n\n\n\n
The situation is different when the accident is entirely caused by another driver<\/strong>.<\/p>\n\n\n\n
In this case, compensation for the damage may be claimed from the responsible party’s insurer in accordance with the applicable procedure.<\/p>\n\n\n\n
However, if you are driving a rental car, this does not necessarily mean that no amount can be temporarily held or charged<\/strong>.<\/p>\n\n\n\n
The rental company may have to wait until the other driver’s liability has been established and the insurance claim has been settled.<\/p>\n\n\n\n
Depending on the rental terms, the company may therefore place a temporary hold on your card or initially charge an amount relating to the damage, with a possible refund or adjustment once compensation has been received.<\/p>\n\n\n\n
Complete documentation is especially important in this situation.<\/p>\n\n\n\n
A CAI signed by the other driver<\/strong>, photographs, complete insurance details, witness statements and any police report can help establish liability.<\/p>\n\n\n\n
<\/span>What happens with Ellepi if the customer is not at fault?<\/strong><\/span><\/h2>\n\n\n\n
Ellepi’s rental terms provide for a specific procedure.<\/p>\n\n\n\n
When a claim is reported by the customer as non-fault<\/strong>, meaning that liability is attributed to the other party, but the CAI is signed only by the customer, Ellepi may place a precautionary charge based on the damage identified while waiting for the insurance claim to be settled.<\/p>\n\n\n\n
If insurance compensation is subsequently received, that amount is used to offset any charge previously applied to the customer.<\/p>\n\n\n\n
If, on the other hand, the customer submits a CAI duly signed by the other party as well<\/strong>, Ellepi’s terms provide that the amount corresponding to the customer’s liability for the damage is not initially charged<\/strong>, subject to the final outcome of the claim.<\/p>\n\n\n\n
If the other party’s insurer subsequently rejects the claim, or shared liability is established, the amounts provided for under the rental agreement may still apply.<\/p>\n\n\n\n
<\/span>What happens if both drivers share responsibility?<\/strong><\/span><\/h2>\n\n\n\n
Responsibility for an accident is not always attributed entirely to one driver.<\/p>\n\n\n\n
In some cases, shared liability<\/strong> may be established, meaning that each driver is held partly responsible for the accident.<\/p>\n\n\n\n
In this situation, compensation may also be proportionate to the percentage of liability established.<\/p>\n\n\n\n
As regards damage to the rental vehicle, the customer’s financial liability will also depend on the rental agreement and any protection purchased.<\/p>\n\n\n\n

An accident involving an uninsured vehicle also requires particular care.<\/p>\n\n\n\n

Ellepi rental rates include third-party liability insurance and a limitation of liability for damage and theft in accordance with the amounts specified in the rental terms.<\/p>\n\n\n\n
Customers can also choose Car Protection<\/strong>, which reduces the maximum charges applicable for damage, theft and fire, or Car Protection Plus<\/strong>, which removes those charges for the events to which the relevant clause applies.<\/p>\n\n\n\n
It is important to clarify that Car Protection and Car Protection Plus are not insurance policies<\/strong>, but contractual waivers that limit the customer’s financial liability.<\/p>\n\n\n\n
Specific exclusions and costs may still remain payable by the driver even when these clauses have been purchased. For this reason, you should always check the terms and conditions in force at the time of booking.<\/p>\n\n\n\n
<\/span>What happens to the security deposit after an accident?<\/strong><\/span><\/h2>\n\n\n\n
The security deposit<\/strong><\/a> does not necessarily correspond to the excess or the customer’s maximum liability.<\/p>\n\n\n\n
In the event of an accident, the rental company may use the guarantee provided by the deposit in accordance with the rental agreement.<\/p>\n\n\n\n
If the cost of the damage cannot be determined immediately, the company may also place a temporary hold on a certain amount while waiting for the damage assessment and settlement of the claim.<\/p>\n\n\n\n
